Terms of Service
Last updated: 16 June 2026
1. About these terms
These Terms of Service ("Terms") govern your use of Motus, a physiotherapy home-exercise prescription platform operated by Fernando Esteban Silva (ABN 71 454 919 024), operating the Motus service under the Avlis brand, based in Western Australia, Australia ("Motus", "we", "us"). By creating an account or using Motus you agree to these Terms. If you do not agree, do not use the service.
2. The service
Motus lets registered physiotherapists record short exercise demonstration clips, set a dosage, and share an exercise program with their patients through a private link. Motus is a tool to support your practice; it is separate from your EMR/practice-management software and is not itself a medical device, and it does not provide clinical or medical advice.
3. Accounts and eligibility
You must provide accurate account information and keep your login credentials secure and confidential. You are responsible for all activity under your account. You confirm that you are an appropriately qualified and registered practitioner (or authorised clinic staff) entitled to deliver the care you use Motus to support, and that you will comply with your professional and legal obligations (including AHPRA registration and the APA Code of Conduct, where applicable).
4. Your patients and their data
You determine how patient information is used and remain the data controller for it; Motus acts only as your processor. You are responsible for having a lawful basis to use Motus with each patient and for obtaining any consent required. Our handling of personal information is described in our Privacy Policy, and our processing obligations are set out in our Data Processing Agreement.
5. Acceptable use
You agree to use Motus only for legitimate clinical purposes and not to: upload unlawful, infringing, or harmful content; record any person without their knowledge and consent; attempt to access another clinic's data or to circumvent the platform's security; or use the service in a way that breaches any law or these Terms.
6. Fees and billing
Motus is free for patients — patients never pay and never enter payment details. Clinic/practitioner subscriptions, where applicable, are billed through our payment provider (Stripe) on the plan you select. Fees are payable in advance for the billing period. You can cancel at any time, effective at the end of the current billing period; unless required by law, fees already paid are non-refundable.
7. Intellectual property
Motus and all associated software, design, and trademarks (including the "Motus" and "Avlis" names and logos) are owned by us. You retain ownership of the content you create (your exercise clips and prescriptions); you grant us the limited rights needed to host, process, and deliver that content to your patients in order to provide the service.
8. Availability and disclaimers
We aim to keep Motus available and reliable, but the service is provided "as is" and "as available" without warranties of any kind, to the extent permitted by law. We do not warrant that the service will be uninterrupted or error-free. Nothing in these Terms limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded. Clinical decisions and patient care remain solely your professional responsibility.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss, or for loss of data, profits, or goodwill, arising from your use of Motus. Where our liability cannot be excluded but can be limited, our total liability is limited to the amount you paid us for the service in the 12 months before the event giving rise to the claim.
10. Suspension and termination
You may stop using Motus and close your account at any time. We may suspend or terminate access if you breach these Terms or to comply with the law. On termination, your data is handled as described in the Privacy Policy and the Data Processing Agreement (including deletion or return of patient data).
11. Changes to these terms
We may update these Terms from time to time. Material changes will be notified through the service or by email. Continued use after a change takes effect constitutes acceptance of the updated Terms.
12. Governing law and contact
These Terms are governed by the laws of Western Australia, Australia, and you submit to the non-exclusive jurisdiction of its courts. Questions about these Terms: contact@avlis.group.
